A memorial to a bicyclist killed by a reckless driver was placed on the spot of the 2006 crash between 101-105 Oldwick Road (Route 523) on Thursday, September 11, 2008, the anniversary date of Michael Grieco's death.

The memorial, a road bike painted white, is known as a ghost bike. Ghost bikes are part of a loosely organized national campaign to raise awareness about cycling safety.

About 25 people attended the installation of the memorial, at which Mike's wife, Pat, and daughter, Trish, both of Whitehouse Station, read recollections and poems.

Defense attorneys want to knock out the most serious criminal charge against an unlicensed driver who caused a fatal accident in Hunterdon County by arguing he once had driving privileges in Costa Rica.

A motion filed on Monday by attorneys representing Anhel Carrillo, 35, of Passaic, said the grand jury which handed up a five-count indictment against him in February never heard the full text of the law he was accused of breaking when bicyclist Michael J. Grieco was killed in 2006.

Court papers claimed the grand jury was told that Carrillo caused the fatal accident, "without ever having been issued a driver's license by this or any other state," a violation of state law.

However, the "extremely pertinent phrase, 'or by another country,' " was omitted, which would have weakened the case for charging Carrillo with a third-degree count of "causing death while unlicensed," according to the motion written by Attorney William J. Marotta III.

"The defendant's license from Costa Rica was obtained and a copy was forwarded to the (Hunterdon County) Prosecutor's Office," which declined to dismiss the charge, Marotta wrote in the motion.

The state plans to prepare a motion in response, said Assistant Prosecutor Harvey Lester, who is handling the case.

Carrillo faces up three to five years in state prison if convicted on the third degree charge -- the first and most serious in the five-count indictment.

The driver, authorities said, was using a license that he obtained with a bogus Social Security card number when Grieco, 72, was struck down on Route 523 in Tewksbury on Sept. 11, 2006.

He died of multiple traumatic injuries, police said.

Anhel Carrillo, 35, of Passaic, N.J. was indicted on one count of third-degree causing death while driving unlicensed on or about Sept. 11, 2006 in Tewksbury Township, two counts of third-degree tampering with public records or information, and two counts of fourth-degree falsifying or tampering with records, and one count of third-degree tampering with public records.
