Mario Lopez was making a delivery on his bike around 11:30am riding east on Metropolitan near Graham when the driver of a huge tractor trailor truck ran him over. The Daily News interviewed the driver, who stayed on the scene stated that he hoped to apologize to Mario's family.
Streetsblog NYC reported that the NYPD immediately blamed Mario for the fatal crash - believing the driver's account that he 'fell under' the truck from the right after he passed him - and did not charge the driver. The truck was beyond the 55foot legal limit allowable in NYC.
